Delhi High Court Slams Delhi Police: Jama Masjid not in Pakistan That CAA Protest Cannot Be Held There


Delhi High Court Slams Delhi Police: A Delhi court on Tuesday slams the Delhi Police for not showing any evidence against Bhim Army chief Chandrashekhar Azad and said that people are on the streets because things which should have been said inside Parliament were not said. Additional Sessions Judge Kamini Lau said that the Delhi Police is behaving as if Jama Masjid is in Pakistan and if so, any person can hold a peaceful demonstration there.


The judge said that Pakistan was once part of undivided India. The court’s remarks came during the hearing on Azad’s bail application. Azad was arrested in a case related to anti-CAA protests at Daryaganj in Old Delhi.

Jama Masjid not in Pakistan


The judge said, ‘The things which should have been said inside the Parliament were not said. This is the reason why people have taken to the streets. We have every right to express our views but we cannot destroy the country. ‘Delhi High Court said that you are behaving as if Jama Masjid is Pakistan and if it is Pakistan then you can go there and protest Huh. Pakistan was a part of undivided India.

The court asked the investigating officer of the police to present all the evidence which indicated that Azad was allegedly making provocative speeches at the Jama Masjid. The investigating officer was also asked to state a law that showed that the assembly was unconstitutional. The court fixed Wednesday for the next hearing of the case.

During the hearing, the police said that they have evidence of drone photographs of the bus assembly as evidence, there is no other recording. To this, the judge said, “Do you think that Delhi Police is so backward that it does not have the equipment to record anything?”

The court said that I should show something or law which prevents such a meeting … Where did the violence take place? Who says you can’t perform … Have you read the Constitution. Performing is the constitutional right of any person.

What is wrong with performing

Regarding the demonstration under the leadership of Bhim Army Chief Chandrasekhar in Daryaganj, the court said that Chandrasekhar Azad is an emerging leader. If they are performing, then what is wrong with it. The judge, who is hearing the case, said that I have seen many cases in which people also protest outside Parliament.

The demonstration took place on 20 December

Actually, on 20 December, there were held protests in many areas of Delhi to protest against the citizenship law. The protesters gathered together at the Jama Masjid in Daryaganj and at India Gate. Protests were also going on near the Jama Masjid in protest against the citizenship law. Bhim Army chief Chandrashekhar Azad was leading the protesters there. During this time there was violence, after which the police lathi-charged and showered water with tankers. Police also tried to take Chandrasekhar into custody but failed at first.

Chandrasekhar was inside the Jama Masjid and the police waited outside to arrest him. Police could not reach him due to being surrounded by supporters and he escaped from there. Chandrasekhar Azad had said that the protest would continue until this black law was withdrawn. The protest has been going on peacefully since noon. The administration entered the Jama Masjid during the day and lathi-charged the people present there. After this Chandrashekhar Azad was taken into custody by the Jama Masjid late night.
